1. Purpose and Acceptance of General Terms and Conditions
The present Terms and Conditions of Sale apply to, without restriction or reserve, to all of the Sales of Products offered by LABORATOIRES DE BIARRITZ France (hereafter "LABORATOIRES DE BIARRITZ") and solely carried out on the website www.laboratoire-biarritz.com (hereafter the "SITE") to customers (hereafter "CUSTOMER").
Accordingly, the act of ordering a product for sale on the website www.laboratoires-biarritz.com by the Customer is equivalent to full acceptance and agreement with the present Terms and Conditions of Sale, of which the Customer recognizes having accepted before placing his/her/the order.

The present Terms and Conditions of Sale only apply to the sale of Products on the Site and come into effect from November 26, 2018. They cancel and replace all previous versions.
LABORATOIRES DE BIARRITZ reserves the right to modify the present Terms and Conditions of Sale at any moment, without notice, it being understood that such modifications with not be applicable to reservations and orders previously accepted and confirmed by the Customer.
The Terms and Conditions of Sale are opposable to the customer who recognizes, by clicking a box provided for this purpose, having read and accepted them before ordering.
The act of confirming an order through confirmation accounts for adhering by the Customer to the General Terms and Conditions of Sale in effect on the day of the order, to be conserved and reproduced by LABORATOIRES DE BIARRITZ professional in accordance with the article 1369-4 of French Civil Code.
The present Terms and Conditions of Sale complete the Terms and Conditions of Use of the Site available at all times under the heading "Legal Notice" of the Site and applicable to the Customer.
2. PRODUCTS
The LABORATOIRES DE BIARRITZ Products presented on the Site are reserved for customers residing in France and Internationally for shipping to these geographic areas.
The Products presented for sale on the present website at the address: www.laboratoires-biarritw.com are the commercial offer of the Site of LABORATOIRES DE BIARRITZ, who reserves the right to modify at any time its collection and to change the list of Product ranges.
The photos of the Products presented on our site are not contractual. However, LABORATOIRES DE BIARRITZ ensures that the photos and drawings accurately depict the product for sale and are not ambiguous, notably concerning the size, weight and quality.
The lists of ingredients that compose the Products of the brand LABORATOIRES DE BIARRITZ are regularly updated. Before using a Product of the brand LABORATOIRES DE BIARRITZ, please read the list of ingredients on the package to ensure that the ingredients are suited to your personal use.

LABORATOIRES DE BIARRITZ will then deliver the order without the product affected by the unavailability. 3. Price
The prices shown on this Site are in Euros, with all taxes included, and may change over the course of the year, it being understood that the Products ordered are charged the prices in effect at the time of the order is recorded.
They do not include shipping, which is charged in addition to the price of the Products purchased in the order. Shipping fees will be displayed before confirmation of the order by the Customer.
The prices include the value-added tax (VAT) applicable on the day of the order and any change of the applicable rate will be automatically reflected in the price of the Products sold by LABORATOIRE DE BIARRITZ on its Site.
Special offers including promotional offers are valid as long as they are advertised on the Site and within the limits of available stocks. Information on the availability of the Products is provided at the time of placing the order, where appropriate.

4. Ordering
LABORATOIRES DE BIARRITZ proposes ordering by the method of your choice, to best satisfy you.
ON THE WEBSITE:
The Customer may consult the details of his/her order in preparation and correct any errors.
When making a purchase, the Customer is limited to a maximum of 6 articles per reference.
From the time that the Customer confirms his/her order by clicking on the icon ["Pay - Order with obligation of payment"] he/she is considered to have accepted and agreed with the conditions of the order and in particular those present in the Terms and Conditions of Sale, the prices, volumes, characteristics, quantities and shipping time of Products for sale and the object of his/her order.
Sales are final from the moment that the Customer has confirmed the order, with prejudicing the right of withdrawal of the Customer (the terms of which are described below). The order will be confirmed by LABORATOIRES DE BIARRITZ by the sending of an email to the Customer, summarizing all of the information previously given by LABORATOIRES DE BIARRITZ, and includes the form for withdrawals.
A second email will be sent to the Customer when the order has been shipped.
LABORATOIRES DE BIARRITZ recommends that the Customer keep both of these emails. Also, in the event of an error in the entry of the specified email address, or of non-receipt of the order confirmation email, LABORATOIRES DE BIARRITZ may not be held responsible.

5 Delivery
Delivery Address.
The Products will be delivered to the address indicated by the CUSTOMER on the order in the "Delivery Address" field, by the means chosen below.
The participation in shipping fees includes taxes.
Delivery time for Products:
The maximum time for delivery is 30 work days from the confirmation of the order.

These delivery times are estimated for orders placed before 12 PM, for an article in stock, and with the condition of having paid by credit card.
Every order placed after 12 PM NOON will be sent the following work day. For orders placed on Fridays after 12 PM, the order will be sent the following Monday. Delivery may also take place on Saturday morning.

Product Delivery Methods:
COLISSIMO La Poste: Delivery WITH/WITHOUT SIGNATURE and pick-up points in Metropolitan France
Participation for shipping fees is €5,9 WITHOUT signature on reception, €6.90 WITH signature on reception and €4,9 at pick-up points. This price applies to delivery in Metropolitan France.
The shipping fees at pick-up points and WITHOUT SIGNATURE on reception are free for any order equal to or above €49 with taxes.
The recipient may track the package with the package number received by email, or, otherwise, via our Customer Service.
When home delivery is chosen, the package is placed directly in the mailbox at the delivery address.
If the mailbox is too small, the package will be either given directly to the recipient of the order, or otherwise and at the initiative of postal services to anyone present at the address who accepts the delivery (neighbor, watchperson, or concierge): the contact info of said person will be put on a notice which will be placed in the mailbox at the indicated address.
In the case that the address given by the CUSTOMER is incorrect, it is up to the CUSTOMER to call DHL courier service or LA POSTE and provide the correct address. If the CUSTOMER realizes once the package has been returned, the CUSTOMER will have to pay the shipping fees once again or may be refunded (except for shipping).

When delivery is chosen at a pick-up point, the Client receives an email on behalf of SoColissimo. The package will be delivered to the pick-up point if provided a signature and on presentation of an identity card. The Customer has 14 calendar days to collect it.

DHL: Express Delivery to France and Internationally, Eco Europe
Participation in shipping fees is €10 for Express delivery with DHL. This price applies to a delivery in Metropolitan France. For other countries, the shipping costs are available in the table above.
The recipient of DHL delivery can track packages with the tracking number received by e-mail or, failing that, through the Customer Service. DHL delivery is upon recipient signature. An ID or the order confirmation email may be requested. If unavailable at the time of delivery, DHL informs the recipient by SMS or calls directly to schedule another delivery.
If the recipient does not reply, the package will be sent back to our warehouse and the return shipping will be at the cost of the Client. The Products ordered will be either refunded or sent again.
Any order confirmed and forwarded to DHL cannot be canceled. After reception by the recipient, the package may be sent back to the warehouse (withdrawal form here), the return shipping fees will be the client's responsibility. 7 Legal Guarantees

If the delivered Products are not in conformity with the Products ordered by the Customer or if they present hidden defects, the Customer must send an email to LABORATOIRES DE BIARRITZ Customer Service here to notify them of the non-compliance or hidden defects in its Product (s).
LABORATOIRES DE BIARRITZ Customer Service acknowledges receiving the Purchaser's request and confirms the procedure to be followed. The Product (s) must be imperatively (i) returned complete, unused, in its intact original packaging and (ii) as far as possible accompanied by their original packaging as well as the return receipt and a photocopy of the invoice.

Upon receipt of the Product (s) presumed to be non-compliant or affected by a hidden defect, LABORATOIRES DE BIARRITZ carries out an examination of the Product (s) to ascertain the (non-)conformity of said Products. Similarly, LABORATOIRES DE BIARRITZ may carry out quality testing on the returned Product(s) by the Customer to verify that the said Product (s) are genuine. c) Content Of Legal Warranties
If the non-conformity of the Product (s) is confirmed or the hidden defect is proven:
The Customer may choose between repair and replacement of the Product, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code. Note that the Customer has a period of two (2) years from the issue of the Product to act and (ii) is exempted from providing proof of the existence of the Product's lack of conformity during the twenty- four (24) months following the delivery of the Product.
As part of the implementation of the guarantee against hidden defects of the object acquired by the CUSTOMER within the meaning of Article 1641 of the Civil Code, he/she may choose between the resolution of the sale or a reduction in the sale's price in accordance with article 1644 of the Civil Code.

8 Retraction
Upon receipt of the Products, the consumer has a retraction period of 14 days to return the Products delivered.

If one of the two cases above occurs (error in the preparation of the order or defective Product(s)) you may request an exchange in the following manner:

9 Responsibility
LABORATOIRES DE BIARRITZ is committed to upholding the obligations resulting from the contract. However, LABORATOIRES DE BIARRITZ can exonerate itself from all or part of its responsibility by proving that the non-performance or the bad execution of the contract is attributable either to the CUSTOMER, or to the unpredictable and insurmountable action of a third party to the contract, or in the event a force majeure (ex: strikes, accidents, riot, fire, etc. constituting unforeseeable and irresistible events).

10 Computing & Freedom
The information collected by LABORATOIRES DE BIARRITZ during any order from the CUSTOMER is necessary for order processing by LABORATOIRES DE BIARRITZ. LABORATOIRES DE BIARRITZ is committed to protecting the confidentiality of personal data transmitted by the CUSTOMER.

12 Disputes
In the absence of a response by Customer Service within a reasonable time to a written complaint from the CUSTOMER, or in the event of failure to reach an amicable agreement in a dispute between the PARTIES, the CUSTOMER may request free mediation in the conditions below.
In accordance with the Ordinance n ° 2015-1033 of August 20, 2015 and with the decree of application n ° 2015-1382 of October 30, 2015, of French Law, the CUSTOMER can seize the CMAP - Center of Mediation and Arbitration of Paris to amicably settle by mediation any disagreement or consumer dispute, subject to Article L612-2 of the Consumer Code.
Disputes cannot be reviewed by the mediator: in which the claim is manifestly unfounded or abusive; has been previously examined or is under consideration by another mediator or court; if the claim is manifestly unfounded or abusive; if the CUSTOMER has submitted his request to the mediator within a period of more than one year from his written complaint to the LABORATOIRES DE BIARRITZ or if the dispute is not within the competence of the mediator; or finally if the consumer does not justify not having attempted, beforehand, to resolve his dispute directly with LABORATOIRES DE BIARRITZ by a written complaint according to the terms provided for, if applicable, in these General Conditions.
To submit the dispute to the mediator, the BUYER may (i) fill out the form on the CMAP website: www.mediateur-conso.cmap.fr, or (ii) send his application by ordinary or registered mail to CMAP Mediation Consumption , 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an email to [email protected]. Regardless of the means used to contact the CMAP, the request must contain the following to be processed quickly:
The CUSTOMER's postal address, email and telephone numbers as well as the full name and address of LABORATOIRES DE BIARRITZ, a brief statement of the facts, and proof of preliminary steps with LABORATOIRES DE BIARRITZ.
13 Applicable Law & Competent Jurisdiction
The present general conditions of sale as well as the selling of LABORATOIRES DE BIARRITZ Products are subjected to the application of the French law.
In the absence of mediation, any dispute relating to the interpretation, performance or breach of contract concluded between LABORATOIRES DE BIARRITZ and the CUSTOMER will be the exclusive jurisdiction of the French courts.
1 Objet et acceptation des conditions générales
Les présentes Conditions de Vente s'appliquent, sans restriction ni réserve, à l'ensemble des ventes des Produits proposées par Les LABORATOIRES DE BIARRITZ France (ci-après dénommé « LABORATOIRE DE BIARRITZ ») et conclues uniquement sur le site Internet www.laboratoires-biarritz.com (ci-après dénommé le « SITE ») aux consommateurs (ci-après dénommé « ACHETEUR »).
En conséquence, le fait pour l’Acheteur de commander un Produit proposé à la vente sur le site internet www.laboratoires-biarritz.com emporte acceptation pleine et entière des présentes Conditions de Vente dont l’Acheteur reconnaît avoir pris connaissance préalablement à sa commande.
Le présent site est la propriété et édité par la Société LABORATOIRES DE BIARRITZ France au capital de 200 000 €, représenté par Bruno Collet, immatriculée au RCS de Bayonne sous le numéro 848 093 167, dont le siège social est au 44, rue Luis Mariano à Biarritz (64200).

Les présentes conditions générales de vente ne s’appliquent qu’à la vente en ligne des Produits sur le SITE et entrent en vigueur à compter du 26 novembre 2018. Elles annulent et remplacent toutes les versions antérieures.
LABORATOIRE DE BIARRITZ se réserve le droit de modifier les présentes Conditions Générales de vente à tout moment, sans préavis, étant entendu que de telles modifications seront inapplicables aux réservations et aux commandes préalablement acceptées et confirmées par l’Acheteur.
Les CGV sont opposables au consommateur qui reconnaît, en cochant une case prévue à cet effet, en avoir eu connaissance et les avoir acceptées avant de passer commande.
La validation de la commande par sa confirmation vaut adhésion par l'acheteur aux CGV en vigueur au jour de la commande dont la conservation et la reproduction sont assurées par le LABORATOIRES DE BIARRITZ professionnel conformément à l'article 1369-4 du Code civil.
Les présentes conditions générales de vente viennent compléter les conditions d’utilisation du SITE disponibles à tout moment dans la rubrique « Mentions légales » du SITE et applicables à l’ACHETEUR.
2. Produits
Les offres de Produits LABORATOIRES DE BIARRITZ présentées sur le Site sont réservées aux consommateurs résidant en France et à l’étranger pour des livraisons dans ces mêmes zones géographiques.
Les Produits proposés à la vente sur le présent site Internet à l'adresse www.laboratoires-biarritz.com constituent l’offre du SITE des LABORATOIRES DE BIARRITZ qui se réserve le droit de modifier à tout moment sa collection et de changer la liste et les gammes de Produits.
Les photos des Produits présentées sur notre site ne sont pas contractuelles. Toutefois, LABORATOIRES DE BIARRITZ veille à ce que les photos et dessins reproduisent fidèlement le produit offert et ne comportent pas d'ambiguïtés sur les notions notamment de dimension, poids, qualité.
Les listes d’ingrédients entrant dans la composition des Produits de la marque LABORATOIRES DE BIARRITZ sont régulièrement mises à jour. Par ailleurs, le montant réglé par l’ACHETEUR pour ledit produit sera remboursé par LABORATOIRES DE BIARRITZ dans un délai de 14 jours suivant cette livraison incomplète. Si le montant de la commande d’origine de l’ACHETEUR lui a permis d’obtenir un avantage (frais de port offert, cadeaux,…), le remboursement des Produits indisponibles n’entraînera pas la perte de ces avantages.

3. Prix
Les prix figurant sur ce SITE sont indiqués en Euros toutes taxes comprises et sont susceptibles de variation en cours d'année, étant entendu que les Produits commandés sont facturés aux prix en vigueur lors de l'enregistrement de la commande.
Ils ne comprennent pas les frais d'expédition, facturés en supplément du prix des Produits achetés suivant le montant de la commande. Les frais d'expédition seront indiqués avant l'enregistrement de la commande par l'ACHETEUR.
Les prix comprennent la taxe sur la valeur ajoutée (TVA) applicable au jour de la commande et tout changement du taux applicable sera automatiquement répercuté sur le prix des Produits vendus par LABORATOIRE DE BIARRITZ au sein de son Site.
Les offres d’achat y compris les offres promotionnelles sont valables tant qu’elles sont annoncées sur le Site et dans la limite des stocks disponibles. Des indications sur la disponibilité des Produits sont fournies au moment de la passation de la commande, le cas échéant.

Le nombre d'échantillons est limité à 1 échantillon par produit et par personne, par adresse postale et par adresse mail. Les échantillons se commandent directement sur le site internet. Le prix de la livraison est de 2,50€ uniquement avec La Poste sans signature. L'envoi d'échantillons se fait uniquement pour la France. 4. Commande
LABORATOIRES DE BIARRITZ vous offre la possibilité de commander selon le moyen de votre choix, afin de mieux vous satisfaire.
SUR LE SITE WEB :
L’Acheteur a la possibilité de vérifier le détail de son projet de commande et de corriger d'éventuelles erreurs.
Lors d'un même achat, l’Acheteur est limité à 6 articles maximum pour une même référence.
A partir du moment où le Acheteur confirme sa commande en cliquant sur l'icône ["REGLER - Commande avec obligation de paiement "], il est considéré comme ayant accepté en connaissance de cause le contenu et les conditions de la commande et en particulier les présentes Conditions de Vente, les prix, volumes, caractéristiques, quantités et délais de livraison des Produits proposés à la vente et commandés par le Acheteur.
La vente sera définitive au moment de la confirmation de la commande par l’Acheteur, sans préjudice de l’exercice par l’Acheteur de son droit de rétractation (dont les modalités sont décrites ci-dessous). Cette commande sera confirmée par LABORATOIRES DE BIARRITZ par l'envoi d'un courrier électronique à l’Acheteur reprenant l’ensemble des informations préalablement délivrées par LABORATOIRES DE BIARRITZ, auquel sera joint le formulaire de rétractation.
Un second courrier électronique sera envoyé à l’Acheteur lors de l'expédition de sa commande.
LABORATOIRES DE BIARRITZ recommande à l’Acheteur de conserver ces deux courriers électroniques. Aussi, en cas d'erreur de saisie de l'adresse de messagerie électronique concernée, ou de non réception du message électronique de confirmation de commande, la responsabilité de LABORATOIRES DE BIARRITZ ne saurait être engagée.
LABORATOIRES DE BIARRITZ sera en droit d'encaisser l'intégralité du prix correspondant à la commande en ce qui concerne les paiements effectués par les autres modes de paiements acceptés sur le site Internet: dès l'envoi du courrier électronique informant l’ACHETEUR de l'expédition de sa commande.
Le Client est invité à préparer sa commande et à se munir de sa carte de paiement au moment de son appel.
Une fois le paiement effectué, nous ne pourrons apporter aucune modification sur la commande pour des raisons logistiques : aucun ajout de produit, modification ..
5 Livraison
Lieu de livraison :
Les Produits seront livrés à l'adresse indiquée par l'ACHETEUR sur le bon de commande dans le champ « Adresse de livraison », selon le mode de livraison choisi ci-dessous.
La participation aux frais de livraison s'entend toutes taxes comprises (TTC).
COLISSIMO
La livraison de colis est assurée pour toute commande sur le site des Laboratoires de Biarritz. Pour toute commande effectuée avant 12h la commande est confiée à la Poste le jour même, sinon elle sera confiée à La Poste le jour ouvré suivant.
Notre service logistique est ouvert du lundi au vendredi.
Pour une livraison à domicile, sans ou avec signature, compter 2-3 jours ouvrés.
CHRONOPOST
La livraison de colis est assurée pour toute commande sur le site des Laboratoires de Biarritz. Pour toute commande effectuée avant 12h la commande est confiée à Chronopost le jour même, sinon elle sera confiée à Chronopost le jour ouvré suivant.
Notre service logistique est ouvert du lundi au vendredi.
Pour une livraison à points relais Shop2shop, compter 2-3 jours ouvrés. Pour une livraison Express en points relais ou a domicile, compter 24h (colis livré le lendemain avant 13h pour toute commande passée avant 12h).

CHRONOPOST : Livraison en points relais Shop2shop, Express à domicile et Express en points relais en France métropolitaine
La participation aux frais de livraison est de 4,90€ en points relais Shop2shop, 6,90€ en livraison express points relais et 10€ en livraison express domicile. Ce tarif s'applique à une livraison en France métropolitaine.
Les frais de livraison en points relais Shop2shop (hors Express) sont offerts pour toute commande supérieure ou égale à 49€ TTC.
Le destinataire peut tracer son colis par le biais du numéro de colis qu’il reçoit par e-mail ou, à défaut, par l'intermédiaire du Service Clients.
Lorsque la livraison est choisie à domicile, le colis est remis en mains propres au destinataire à l’adresse de livraison.
En cas d’absence du destinataire, votre colis sera mis en instance 14 jours en bureau de poste, agence Chronopost ou 7 jours en relais Pickup.
Pour les livraison Express (Domicile ou Point relais), le colis est livré le lendemain avant 13h du lundi au vendredi, sauf jours fériés. La livraison le samedi est possible sur option.
Dans le cas où l’adresse saisie par l’ACHETEUR est incorrecte, c’est à l’ACHETEUR d’appeler directement le transporteur CHRONOPOST en communiquant sa bonne adresse. Si l’ACHETEUR s’en rend compte une fois que le colis nous est revenu, l’ACHETEUR devra payer à nouveau les frais de port ou pourra se faire rembourser (hors frais de port).
Dans le cas où l’ACHETEUR n'est pas allé récupérer son colis CHRONOPOST en bureau de poste, agence ou relais Pickup dans les délais communiqués, le colis sera alors renvoyé aux LABORATOIRES DE BIARRITZ. L’ACHETEUR pourra alors choisir de se faire renvoyer son colis en payant à nouveau les frais de port ou pourra se faire rembourser (hors frais de port).
COLISSIMO La Poste : Livraison SANS, AVEC SIGNATURE et points relais en France métropolitaine et en Belgique
La participation aux frais de livraison est de 4,90€ SANS signature, 6,90€ AVEC signature et 4,90€ en points relais. Ce tarif s'applique à une livraison en France métropolitaine.
Les frais de livraison en points relais et SANS SIGNATURE sont offerts pour toute commande supérieure ou égale à 49€ TTC en France métropolitaine.
La participation aux frais de livraison est de 5,90€ SANS signature et 4,90€ en points relais. Ce tarif s'applique à une livraison en Belgique.
Les frais de livraison en points relais sont offerts pour toute commande supérieure ou égale à 49€ TTC en Belgique.
Le destinataire peut tracer son colis par le biais du numéro de colis qu’il reçoit par e-mail ou, à défaut, par l'intermédiaire du Service Clients.
Lorsque la livraison est choisie à domicile, le colis est remis directement dans la boîte aux lettres à l’adresse de livraison.
Dans le cas où la boite aux lettres est de taille insuffisante, le colis est remis soit au destinataire de la commande, soit à défaut et à l’initiative de La Poste à toute autre personne présente à l’adresse qui accepte d’en prendre livraison (un voisin, un gardien ou concierge) : les coordonnées de ce dernier seront indiquées sur un avis remis dans la boîte aux lettres à l’adresse indiquée.
Dans le cas où l’adresse saisie par l’ACHETEUR est incorrecte, c’est à l’ACHETEUR d’appeler directement le transporteur LA POSTE en communiquant sa bonne adresse. Si l’ACHETEUR s’en rend compte une fois que le colis nous est revenu, l’ACHETEUR devra payer à nouveau les frais de port ou pourra se faire rembourser (hors frais de port).

Lorsque la livraison est choisie en point relais, le Client reçoit un email de la part de SoColissimo. Le colis sera remis par le point relais contre signature et sur présentation d'une pièce d'identité. Le Client a 14 jours calendaires pour le retirer.
Lorsque le colis n’a pu être livré selon les modalités prévues ci-dessus, un avis de mise en instance est laissé par La Poste dans la boîte aux lettres du destinataire indiquant les coordonnées du Bureau de Poste dans lequel le destinataire pourra retirer le colis dans un délai de 14 jours calendaires.
Si le destinataire ne retire pas son colis dans les délais indiqués par les services postaux, celui-ci reviendra dans notre entrepôt et les frais de retour seront facturés au Client. Les Produits commandés seront soit remboursés (hors frais de port), soit réexpédiés (avec frais de port à la charge du client).
En cas de contestation relative à la livraison elle-même, le système informatique (flashage) ou le Suivi Colis en ligne de La Poste fera foi sauf preuve contraire rapportée par le Client.
DHL : Livraison Expresse France et International, Eco Europe
La participation aux frais de livraison est de 10€ pour une livraison en Express avec DHL. Ce tarif s'applique à une livraison en France métropolitaine. Pour les autres pays, les frais de port sont consultables ci-dessus dans le tableau.
Le destinataire par livraison DHL peut tracer son colis par le biais du numéro de colis qu’il reçoit par e-mail ou, à défaut, par l'intermédiaire du Service Clients. La livraison DHL se fait contre signature du destinataire. Une pièce d’identité ou l’e-mail de confirmation de commande pourra être demandé. S’il n’est pas disponible lors de la livraison, DHL prévient le destinataire par sms ou l’appelle directement pour programmer une autre livraison.
Si le destinataire ne répond pas, le colis reviendra dans notre entrepôt et les frais de retour seront facturés au Client. Les Produits commandés seront soit remboursés, soit réexpédiés.
Toute commande validée et transmise au transporteur DHL ne pourra pas être annulée. Après réception par le destinataire, le colis pourra être renvoyé à l’entrepôt (formulaire de rétractation ici), les frais de retour sont à la charge du client. Dès réception du colis par notre entrepôt, la commande est annulée et le client sera remboursé de ses Produits sous 14 jours ouvrés. Le montant maximum de remboursement des frais de livraison initiaux sera celui de la Livraison standard.
Retrait aux LABORATOIRES DE BIARRITZ
Le colis peut être est livré aux LABORATOIRES DE BIARRITZ, comme choisi par le Client dans la liste proposée au moment du choix de la livraison.
La participation aux frais de livraison est offerte aux LABORATOIRES DE BIARRITZ.
Le Client recevra un email de confirmation lorsque le colis sera prêt et disponible aux Laboratoires. Son colis restera à sa disposition pendant 14 jours calendaires. Pour le récupérer, le Client devra présenter une pièce d’identité en cours de validité.
Passé ce délai de 14 jours, le colis sera réintégré en stock et le Client sera remboursé du montant de sa commande.
Retard de livraison
En cas de dépassement du délai maximal de livraison de trente (30) jours, l’ACHETEUR peut exercer son droit de dénonciation de la commande auprès du Service Client ici.
A compter de l'exercice du droit de dénonciation, LABORATOIRES DE BIARRITZ effectue un remboursement de la totalité des sommes versées par l’ACHETEUR (frais de livraison inclus), selon le mode de paiement utilisé dans un délai maximum de quatorze (14) jours à compter de la réception de la dénonciation, et ce, à l'exclusion de toute autre indemnisation. A ce titre, l’attention de L’ACHETEUR est attirée sur le fait que la carte bancaire ayant servi au paiement doit toujours être en cours de validité afin de permettre un remboursement dans le respect du délai précité.
Tout retard de livraison doit être signalé le plus rapidement possible par l’ACHETEUR par courrier électronique en cliquant ici, afin que le LABORATOIRES DE BIARRITZ puisse faire effectuer une enquête auprès du Transporteur. L’ACHETEUR est informé que la durée de réalisation d'une enquête est aléatoire et peut être relativement longue, LABORATOIRES DE BIARRITZ ne maîtrisant pas sa réalisation. Si au cours de cette enquête, la commande est retrouvée, elle sera immédiatement réacheminée au lieu de livraison désigné dans la commande. Si à l'issue de cette enquête la perte de la commande est confirmée, le LABORATOIRES DE BIARRITZ effectue, à ses frais, une réexpédition du ou des Produit(s) à l’ACHETEUR ou en cas d'indisponibilité définitive, rembourse, sur le compte bancaire débité lors de la commande, l’Acheteur des sommes encaissées.
Réception
Chaque livraison est réputée effectuée dès mise à disposition du ou des Produit(s) auprès de l’ACHETEUR par le Transporteur. Il appartient à l’ACHETEUR de vérifier immédiatement, au moment de la réception du/des Produit(s), la conformité et l'intégrité du ou des Produit(s) expédié(s). Toute anomalie/réserve identifiée au moment de la livraison (notamment livraison en retard, produit manquant ou endommagé) doit être signalée de façon complète et précise par l’ACHETEUR sur le récépissé remis par le Transporteur au moment de la mise à disposition des Produits et/ou confirmé par lettre recommandée au Transporteur dans les trois (3) jours qui suivent la réception de la commande. Toute réserve de ce type doit être notifiée en parallèle et dans les meilleurs délais au Service Client de LABORATOIRES DE BIARRITZ ici. Une copie de la réclamation adressée au Transporteur devra être jointe.
Pour une livraison hors de l’Union Européenne, le Client devra s’acquitter des droits de douanes ou autres taxes dues à l’occasion de l’importation des Produits dans le pays du lieu de livraison. Les formalités qui s’y rapportent sont également à la charge exclusive du Client, sauf indication contraire.
Le Client est seul responsable de la vérification des possibilités d’importation des Produits commandés au regard du droit du territoire du pays de livraison.
6 Paiement
Le Paiement sur le SITE se fait via une carte de paiement sur :
- Payplug : cartes de crédit et de débit de type Visa et MasterCard, européennes et internationales. Cela inclut les cartes Electron (Visa) et Maestro (Mastercard). Contrôle de la transaction :
En cas d’achat d’un ou plusieurs PRODUITS sur le SITE via une carte de paiement, l’ACHETEUR indique directement dans les zones prévues à cet effet : le numéro de carte, sa date de validité ainsi que son code de contrôle situé au dos de la carte. La totalité du montant de la commande sera débitée de la carte bancaire au jour de la commande.
Dans le cas où un remboursement serait accepté par le LABORATOIRES DE BIARRITZ, celui sera effectué en utilisant le même moyen de paiement que celui utilisé par l’ACHETEUR pour le règlement initial de la commande dans un délai de 30 jours.
LABORATOIRES DE BIARRITZ se réserve le droit de suspendre toute gestion de commande et toute livraison en cas de non-paiement ou de refus d'autorisation de paiement par carte bancaire de la part des organismes officiellement accrédités et habituels de l'internet.
LABORATOIRES DE BIARRITZ se réserve la possibilité de refuser d'honorer une commande provenant d'un ACHETEUR qui n'aurait pas réglé pour tout ou partie d'une précédente commande ou avec qui un litige de paiement subsisterait.
LABORATOIRES DE BIARRITZ ne saurait être tenu pour responsable de toute malversation ou utilisation frauduleuse d'un quelconque moyen de paiement qui n'aurait pas été détecté par la procédure de vérification. L’ACHETEUR garantit à LABORATOIRES DE BIARRITZ qu’il dispose des autorisations nécessaires pour utiliser le mode de règlement qu’il aura choisi pour sa commande.
Toute utilisation frauduleuse de la carte bancaire ne pourra donner lieu à remboursement par LABORATOIRES DE BIARRITZ.

Pour accroître la sécurisation de vos informations bancaires, LABORATOIRES DE BIARRITZ ne les conserve pas. C'est pourquoi, vous devrez nous les communiquer à chaque nouvelle commande.
LABORATOIRES DE BIARRITZ se réserve la propriété des Produits livrés jusqu'au paiement complet du prix.
7 Garanties Légales
a) Description des garanties légales
Conformément aux articles L. 217-4 et suivants du Code de consommation, le LABORATOIRES DE BIARRITZ est tenu de livrer un Produit conforme à la commande réalisée par l’Acheteur et doit répondre des défauts de conformité existant au moment de la délivrance de ce dernier.
A ce titre, pour être conforme au contrat, le Produit doit :
1) Etre propre à l'usage habituellement attendu d'un Produit semblable et, le cas échéant :
- correspondre à la description donnée par le LABORATOIRES DE BIARRITZ et posséder les qualités que celui-ci a présentées à l'Acheteur sous forme d'échantillon ou de modèle;
- présenter les qualités qu'un Acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le LABORATOIRES DE BIARRITZ, par le producteur ou par son représentant, notamment dans la publicité ou l'étiquetage ;
2) Ou présenter les caractéristiques définies d'un commun accord par les Parties ou être propre à tout usage spécial recherché par l'Acheteur, porté à la connaissance du LABORATOIRES DE BIARRITZ et que ce dernier a accepté.
De même, conformément à l’article 1641 du Code civil, le LABORATOIRES DE BIARRITZ est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage que l'Acheteur ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les avait connus.
b) Procédure à suivre :
Si les Produits livrés sont non-conformes aux Produits commandés par l’Acheteur ou s’ils présentent des vices-cachés, ce dernier doit envoyer un courrier électronique au Service client de LABORATOIRES DE BIARRITZ ici pour lui notifier la non-conformité ou les vices-cachés de son (ses) Produit(s).
Le Service Client du LABORATOIRES DE BIARRITZ accuse réception de la demande de l’Acheteur et lui confirme la procédure à suivre. A réception des instructions du Service Client du LABORATOIRES DE BIARRITZ, l’Acheteur renvoie les Produits non-conformes ou affectés d’un vice-caché au LABORATOIRES DE BIARRITZ à l’adresse suivante :

Le(s) Produit(s) doit/doivent être impérativement (i) renvoyé(s) complet(s), non utilisé(s), dans son (leur) conditionnement d’origine intact et (ii) dans la mesure du possible accompagné(s) de son (leur) emballage d'origine ainsi que du bon de retour et d’une photocopie de la facture.
Par ailleurs, LABORATOIRES DE BIARRITZ n'accepte pas les colis adressés en port dû. Tout risque lié au retour du ou des Produit(s) est à la charge de l’Acheteur.
A réception du ou des Produit(s) présumé(s) non-conforme(s) ou affectés d’un vice caché, le LABORATOIRES DE BIARRITZ réalise un contrôle du ou des Produit(s) pour constater la conformité ou non desdits Produits. De même, LABORATOIRES DE BIARRITZ peut procéder sur le(s) Produit(s) retourné(s) par l’Acheteur à un test qualité pour vérifier que le(s) Produit(s) retourné(s) sont bien de(s) Produit(s) d’origine. Il est entendu que ces contrôles sont effectués dans les plus brefs délais et dans un délai maximum d’un (1) mois.
c) Contenu des garanties légales
Si le caractère non conforme du ou des Produits est confirmé ou que le vice-caché est avéré :
L’Acheteur peut choisir entre la réparation et le remplacement du Produit, sous réserve des conditions de coûts prévues par l’article L. 217-9 du Code de la consommation. A noter que l’ACHETEUR bénéficie d’un délai de deux (2) ans à compter de la délivrance du Produit pour agir et (ii) est dispensé de rapporter la preuve de l’existence du défaut de conformité du Produit durant les vingt-quatre (24) mois suivant la délivrance du Produit.
Dans le cadre de la mise en œuvre de la garantie contre les défauts cachés de la chose vendue par l’ACHETEUR au sens de l’article 1641 du Code civil, il peut choisir entre la résolution de la vente ou une réduction du prix de vente conformément à l’article 1644 du Code civil.
LABORATOIRES DE BIARRITZ rappelle à ses ACHETEURS que les Produits doivent être conservés à l'abri de l'humidité, d'une température trop élevée ou d'une luminosité trop intense et peuvent être soumis à une date de péremption. Seront donc exclus de la garantie les Produits qui n'auraient pas été stockés dans les conditions précitées.
8 Rétractations ( politique de retour )
À compter de la réception des Produits, le consommateur dispose d'un délai de rétractation de 14 jours francs pour renvoyer les Produits livrés.
Les frais et risques liés au retour du produit sont à la charge du Client qui l’expédie. Le retour des produits donnera lieu à un remboursement égal au prix d’achat du ou des produit(s) acheté(s) (hors frais de port).
Dès le traitement du retour, le montant du remboursement sera communiqué par email au Client et crédité sur le moyen de paiement ayant servi à la transaction. Le produit sera remboursé uniquement s'il est neuf et n'a pas été utilisé.
Les LABORATOIRES DE BIARRITZ procéderont uniquement à des retours à leurs frais en cas d’erreur de préparation de commande ou Produits défectueux. Une fois réceptionnés dans nos entrepôts, les produits défectueux seront remboursés au client.
Si un des 2 cas ci-dessus vous arrive (erreur de préparation de commande ou Produits défectueux), vous pouvez demander à vous faire échanger le ou les Produits de la manière suivante :
1) Envoyez un mail à l’adresse contact en utilisant ce formulaire de contact dans les 14 jours après réception de votre commande en précisant le numéro de votre commande, le produit que vous désirez retourner, celui que vous voulez en échange et la cause de l’échange (erreur de préparation ou Produits défectueux).
2) Nous vous répondons au plus vite en vous faisant parvenir par mail un bon de retour à coller sur votre colis. Il suffit ensuite de l’emmener dans votre bureau de Poste ou le déposer dans votre boite aux lettres. Le produit est retourné du fait de notre responsabilité, nous vous remboursons donc les frais de retours.
3) Nous réceptionnons votre colis à échanger puis nous vous renvoyons le ou les Produits correspondants au plus vite.
Merci de ne renvoyer aucun produit sans accord préalable par email. Tout retour sans accord préalable sera refusé à réception.

9 Responsabilité
LABORATOIRES DE BIARRITZ s’engage à la bonne exécution des obligations résultant du contrat. Toutefois, LABORATOIRES DE BIARRITZ peut s'exonérer de tout ou partie de sa responsabilité en apportant la preuve que l'inexécution ou la mauvaise exécution du contrat est imputable soit à l’ACHETEUR, soit au fait, imprévisible et insurmontable, d'un tiers au contrat, soit à un cas de force majeure (ex : grèves, accidents, émeute, incendie, etc. constituant des événements imprévisibles et irrésistibles).
La responsabilité de LABORATOIRES DE BIARRITZ ne saurait non plus être engagée en cas d’inconvénients ou dommages résultant de l’utilisation du réseau Internet tel que notamment virus, intrusion, perte de données, rupture du service internet.
10 Informatique & Libertés
Les informations collectées par LABORATOIRES DE BIARRITZ lors de toute commande de l’ACHETEUR sont nécessaires au traitement des commandes par LABORATOIRES DE BIARRITZ. LABORATOIRES DE BIARRITZ s’engage à préserver la confidentialité des données personnelles transmises par l’ACHETEUR.
Conformément à la loi informatique et libertés n° 78-17 du 6 janvier 1978 telle que modifiée et au Règlement Général pour la Protection des Données n°2016/679 en date du 27 avril 2016, l’ACHETEUR dispose d'un droit d'accès, de rectification, d’opposition, d’effacement sous réserve de motifs légitimes, de portabilité des données le concernant ainsi qu’un droit à la « mort numérique ». L’ACHETEUR peut exercer ces droits. Pour exercer ces droits, il vous suffit d’en faire la demande écrite via le formulaire de contact rubrique « Données personnelles/RGPD », accompagnée d’un justificatif d’identité.
LABORATOIRES DE BIARRITZ est susceptible d’adresser par courrier postal ou par courrier électronique des offres promotionnelles, notamment l'e-newsletter sous réserve de l’accord préalable donné par l’ACHETEUR dans le cadre de la procédure d’inscription.

11 Propriété Intellectuelle
Le SITE est une œuvre de l’esprit protégée par le Droit de la Propriété Intellectuelle. Le SITE et chacun des éléments qui le composent (tels que, notamment marques, logos, photographies, images, illustrations, textes, slogans, vidéo.) sont la propriété exclusive de LABORATOIRES DE BIARRITZ, seule habilitée à utiliser les droits de la propriété intellectuelle et droits de la personnalité y afférent.
Aucun droit d’utilisation ne saurait être attribué sur l’un quelconque des droits de propriété intellectuelle figurant sur le SITE. LABORATOIRES DE BIARRITZ se réserve le droit de poursuivre toute atteinte à ses droits de propriété intellectuelle.

12 Litiges
En l’absence de réponse dans un délai raisonnable par le Service Consommateurs à une réclamation écrite de l’ACHETEUR ou à défaut de parvenir à un accord amiable relatif à un différend né entre les PARTIES, l’ACHETEUR peut gratuitement demander une médiation dans les conditions ci-après.
Conformément à l’ordonnance n°2015-1033 du 20 août 2015 et au décret d’application n°2015-1382 du 30 octobre 2015, l’ACHETEUR peut saisir le CMAP – Centre de Médiation et d’Arbitrage de Paris pour régler de manière amiable par médiation tout différend ou litige dit de consommation, sous réserve de l’article L612-2 du code de la consommation.
Ne peuvent faire l’objet d’une revue par le médiateur les litiges pour lesquels, la demande est manifestement infondée ou abusive, ou a été précédemment examinée ou est en cours d’examen par un autre médiateur ou par un tribunal, ou si l’ACHETEUR a introduit sa demande auprès du médiateur dans un délai supérieur à un an à compter de sa réclamation écrite auprès du LABORATOIRES DE BIARRITZ ou si le litige n’entre pas dans le champ de compétence du médiateur, ou enfin si le consommateur ne justifie pas avoir tenté, au préalable, de résoudre son litige directement auprès de LABORATOIRES DE BIARRITZ par une réclamation écrite selon les modalités prévues, le cas échéant, dans les présentes Conditions Générales.
Pour soumettre son litige au médiateur, l’ACHETEUR peut (i) remplir le formulaire sur le site internet du CMAP : www.mediateur-conso.cmap.fr, ou (ii) envoyer sa demande par courrier simple ou recommandé au CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, ou (iii) envoyer un email à [email protected]. Quel que soit le moyen utilisé pour saisir le CMAP, sa demande doit contenir les éléments suivants pour être traitée avec rapidité :

13 Loi Applicable & Juridiction Compétente
Les présentes conditions générales de vente ainsi que les ventes de Produits de LABORATOIRES DE BIARRITZ sont soumises à l'application du droit français.
A défaut de médiation, tout litige relatif à l’interprétation, l’exécution ou la rupture du contrat conclu entre LABORATOIRES DE BIARRITZ et l’ACHETEUR sera de la compétence exclusive des tribunaux français.
